Terms of Service & Privacy

These Terms of Service and Privacy Policy (the “Terms”) govern your access to and use of Keep (the “Service”), operated by OwnedSelf (“Keep,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Keep lets you bring in your personal writing — images of handwritten pages, which we transcribe, and typed notes you paste or import — then dates, orders, and indexes them, and offers features (search, the “Ask” assistant, and a daily “Spark”) that draw on your own archive. The Service is provided for your personal use.

2. Your Account

You must provide a valid email address and are responsible for activity under your account. Keep your sign-in link confidential. You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service.

3. Subscriptions, Billing & Refunds

Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor. Fees are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period. We may change plan pricing with reasonable advance notice; changes apply to subsequent billing periods.

4. Your Content & License

You retain all ownership of the pages, images, and text you upload (“Your Content”). You grant Keep a limited, non-exclusive license to store, process, transcribe, index, and display Your Content solely to operate and provide the Service to you. We do not sell Your Content, and we do not use Your Content to train artificial-intelligence models. You are responsible for ensuring you have the right to upload Your Content.

5. Acceptable Use

You agree not to use the Service to upload unlawful content, infringe others’ rights, attempt to breach security or access other users’ data, reverse-engineer the Service, or use it in any manner that violates applicable law.

6. Third-Party Services

The Service relies on third-party providers to function, including cloud hosting and database/storage (Supabase, Vercel), AI features — transcription, the “Ask” assistant, and daily “Spark” — via the Anthropic API, email delivery (Resend), and payment processing (Stripe). Your use of the Service involves transmitting Your Content to these providers as necessary to operate the Service. Their handling of data is governed by their respective terms and privacy policies.

7. Privacy

We collect your email address, the writing you bring in (scanned pages and typed notes), the transcriptions and dates generated from it, and basic account and usage information, used solely to provide, secure, and improve the Service. Your Content is isolated to your account so that other users cannot access it, and our staff’s access is limited to account information and aggregate counts — not the content of your pages.

To operate the Service we share Your Content only with the providers that run it: cloud hosting, database, and storage (Supabase, Vercel); AI features — transcription, “Ask,” and daily “Spark” (Anthropic); email (Resend); and payments (Stripe). Your Content is sent to Anthropic only to transcribe your scanned pages and to power features that draw on your own writing (the “Ask” assistant and your daily “Spark”); typed notes you import are not sent for transcription. It is not used to train AI models, and these features draw only on your own pages. We do not sell your personal information or Your Content, and we do not use it for advertising.

You can export a complete copy of Your Content, and permanently delete your account and Content, at any time from your account settings. The Service does not provide end-to-end (zero-knowledge) encryption — processing your pages requires reading them. For a plain-language explanation, see How your data is handled.

8. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Keep and protected by law. These Terms grant you no rights to our intellectual property other than to use the Service as permitted.

9. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Transcription and dating are automated and may contain errors; you are responsible for reviewing results. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Keep will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Keep from any claims arising out of Your Content or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or as required by law. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by reasonable means; continued use after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. You and Keep agree that the exclusive venue for any dispute not subject to arbitration shall be the state or federal courts located in Utah, and you consent to their jurisdiction.
